Illinois, like most other states, has enacted legislation requiring vehicle owners to have a minimum amount of liability insurance. Liability insurance is required should the vehicle owner or driver cause an accident which results in injury to another individual or damage to someone else’s property. Illinois is a “Fault” Vehicle Accident State
In Illinois, the person found to be at fault for causing the accident is the person responsible for compensating anyone who suffered harm because of the accident. This is known as a “fault system.” Although it is the at-fault driver who is responsible for compensating the other party, in truth, it is the at fault drivers’ insurance carrier that covers the damages up to the policy limits.
Auto Insurance in Illinois Is Mandatory
Vehicle owners in Chicago and throughout Illinois are required to carry liability insurance if the vehicle is registered in the state. The minimum coverage is:
- $25,000 for injury to one person
- $50,000 total for all injuries to others sustained in the accident, and
- $20,000 for damage to property
Liability insurance is designed to cover medical expenses, vehicle repair, injury to drivers, passengers, and pedestrians or anyone who sustained property damage. Although there is a mandatory minimum liability insurance cover, it is wise to carry more insurance. Once the limit on the policy has been exhausted, you, as the vehicle owner, are personally liable for any outstanding balance. Higher insurance coverage will protect your assets in the event of a serious accident.
Liability insurance only covers injuries to others and damage to other people’s property. Consulting with a knowledgeable insurance executive is wise. It is better to be safe than sorry.
